Terms of Use
These terms apply to the clinical software operated by The Mind Project and used by The Mind Project and other registered clinics (“the service”). They cover clinic staff who sign in, and patients who open a document the clinic sends them. By using the service you agree to them. How personal data is handled is described in the Privacy Policy.
1. The service
The service helps a clinic register patients, manage appointments and the day’s queue, keep medical records, and write, sign and share prescriptions. It is a record-keeping tool. It does not give medical advice, and all clinical decisions are made by the clinic’s registered medical practitioners.
2. For patients
- A link to your prescription is private to you. It expires after 7 days and the clinic can withdraw it. Please do not forward it.
- If something in a document looks wrong, contact the clinic. Only your clinician can change your treatment.
- You can ask the clinic for your records, correct your details, or withdraw consent at any time, as set out in the Privacy Policy.
3. Staff accounts
- Accounts are personal. Do not share your password or let anyone else use your account, and sign out on shared devices. Tell the clinical director at once if you think your account has been misused.
- The clinical director adds and removes staff and must switch off an account as soon as a person leaves or no longer needs access.
- Open only the records you need for your work. Every access is recorded and may be reviewed.
- Do not copy, export or send patient information outside the service except for patient care or as the law requires, and never upload malicious files or try to get round access controls.
4. Professional responsibilities of clinicians
- Only a registered medical practitioner may sign clinical records and prescriptions, and only after completing their professional profile with qualifications, State Medical Council or National Medical Commission and registration number, which appear on every signed prescription.
- Prescriptions should be legible, name medicines by their generic names where possible, and state dose, route, frequency and duration, in line with the National Medical Commission’s regulations.
- Teleconsultations must follow the Telemedicine Practice Guidelines, 2020: confirm the patient’s identity, record their consent, and do not prescribe medicines that those guidelines prohibit for teleconsultation, including those under Schedule X of the Drugs and Cosmetics Rules or the NDPS Act.
- Mental health records are confidential under the Mental Healthcare Act, 2017. Respect advance directives and the role of nominated representatives, and share information only as that Act allows.
- Signed records cannot be changed; corrections are added as dated amendments. Records must be kept for at least three years from the patient’s last visit, and copies provided when a patient or a lawful authority asks, within 72 hours where the regulations require it.
5. Data protection
Each clinic is the Data Fiduciary for the personal data of its patients under the Digital Personal Data Protection Act, 2023. The clinic gives patients its privacy notice, records their consent, appoints a grievance officer, answers requests to access, correct or erase data, and decides how long records are kept. The Mind Project processes that data only on the clinic’s instructions, keeps it confidential, protects it with reasonable security safeguards, and tells the clinic without delay of any personal data breach so that the clinic can inform the Data Protection Board of India and the people affected.
6. Availability
We work to keep the service available and backed up, but it may occasionally be interrupted for maintenance or reasons beyond our control. Clinics should keep a way of caring for patients if the service is unavailable.
7. Suspension
Access may be suspended to protect patients or the service, for example if an account is misused, or when a clinic stops using the service. Records are then kept or returned in line with the law and the clinic’s retention policy.
8. Liability
To the extent the law allows, The Mind Project is not responsible for clinical decisions, or for losses caused by information entered incorrectly or by misuse of an account. Nothing in these terms limits rights that cannot be limited under Indian law.
9. Law
These terms are governed by the laws of India, and disputes are subject to the jurisdiction of the competent courts in India.
